FindEdition Terms of Service

If you choose to use FindEdition products or services displaying or otherwise governed by these Terms of Service, including FindEdition.com (the "Site"), FindEdition's mobile sites and applications, any of the features of the Site, including but not limited to search tools, APIs, and Software (as defined below) and other downloads, and FindEdition's services (collectively, the "Services"), you will be agreeing to abide by all of the terms and conditions of these Terms of Service between you and FindEdition.

1(A) Acceptance of Terms

By accessing or using any part of the Services, you agree to be bound by these Terms of Service. If you do not agree to these Terms of Service, you may not access or use the Services. Your use of the Services constitutes your acceptance of these Terms of Service and your agreement to be bound by them.

1(B) Changes to Terms

We may change, add or remove portions of these Terms of Service at any time by notifying you. Such changes will become effective immediately upon posting. It is your responsibility to review these Terms of Service prior to each use of the Site. We will notify you of material changes through:

IF ANY OF THE TERMS AND CONDITIONS OF THESE TERMS OF SERVICE, OR ANY FUTURE CHANGES, ARE UNACCEPTABLE TO YOU, YOU MAY: (1) CANCEL YOUR ACCOUNT AND/OR (2) DISCONTINUE YOUR USE OF THE SERVICES. YOUR CONTINUED USE OF THE SERVICES NOW, OR FOLLOWING THE POSTING OF UPDATED TERMS OF SERVICE, WILL INDICATE ACCEPTANCE BY YOU OF SUCH TERMS OF SERVICE, CHANGES, OR MODIFICATIONS.

1(C) Service Modifications

We may change, suspend or discontinue any aspect of the Services at any time, including the availability of any Services feature, database, or content. We may also impose limits on certain features and services or restrict your access to parts or all of the Services without notice or liability. This includes but is not limited to:

• Content sections (News, Editorial, Magazine, Archive, Press, Tech, Docs, Research, Trends, Events, Podcast, Labs, Academy, Creators)
• Entertainment features (Movies, Series, Anime)
• Work marketplace features (Jobs, Freelancers, Companies, Services)
• Tools and utilities (PDF tools, image tools, text tools, SEO tools, converter tools, generator tools, checker tools, developer tools)
• Community features (Questions, Answers, Discussions)
• AI features (AI Chat, AI-assisted content generation)
• Subscription and premium features
• Advertising and monetization features

1(D) Advertising

Being exposed to advertising is a condition of accessing the Services. FindEdition may display advertisements on the Services, including but not limited to banner ads, sponsored content, native advertising, and promotional materials. These advertisements may be targeted based on your interests, browsing behavior, and other factors. You may have the option to opt out of certain types of personalized advertising through your account settings.

Advertisers are responsible for the content of their advertisements. FindEdition does not endorse or guarantee the accuracy of any advertisement or the products or services advertised. Your interactions with advertisers are solely between you and the advertiser.

The contents of the Services, including the Site, are intended for your personal, non-commercial use. All materials published or available on the Services are protected by copyright, and owned or controlled by FindEdition or its licensors.

2(A) Intellectual Property Rights

The Services and Content are protected by copyrights, trademarks, patents, trade secrets, database rights, sui generis rights and other intellectual or proprietary rights pursuant to Pakistan and international laws. You may not modify, publish, transmit, participate in the transfer or sale of, reproduce (except as provided below), create new works from, distribute, perform, display, communicate to the public or in any way exploit, any of the Content in whole or in part.

All content on FindEdition, including but not limited to:

• News articles, editorials, magazine content, research articles, trends, events, podcasts, labs content, academy content, press releases, tech articles, documentation, and creator content
• Entertainment content including movie reviews, series information, anime content, ratings, and reviews
• Work marketplace content including job postings, freelancer profiles, company profiles, and service listings
• Tools, utilities, and software provided through the Services
• Design elements, graphics, logos, icons, and visual content
• User interfaces, layouts, and website design
• Databases, data compilations, and structured data

...are the exclusive property of FindEdition or its content providers and are protected by copyright and other intellectual property laws.

2(B) Limited Personal Use License

You may download or copy certain Content and other downloadable items displayed on the Services for your personal use only, provided that you maintain all copyright and other notices contained in the Content and other downloadable items. Copying or storing of any Content for other than personal use is expressly prohibited without prior written permission from FindEdition.

Permitted Uses:

• Reading and viewing content for personal, non-commercial purposes
• Sharing links to content on social media platforms
• Printing articles for personal use
• Downloading content to your personal device for offline reading
• Using content for educational purposes (with proper attribution)

Prohibited Uses:

• Republishing or redistributing content without permission
• Using content for commercial purposes without authorization
• Creating derivative works based on our content
• Scraping or systematically downloading large amounts of content
• Using content to train AI models or machine learning systems without permission
• Removing copyright notices or attribution

2(C) FindEdition Services

FindEdition Services include, but are not limited to:

FindEdition allows users to create, upload, post, send, or submit content on the Services. This includes but is not limited to: articles, comments, reviews, questions, answers, job postings, freelancer profiles, service listings, company profiles, entertainment reviews, tool reviews, discussions, and other user-generated content.

3(A) Your Rights and Responsibilities

If you upload, post, send, or submit any content on the Services, you represent to us that you have all the necessary legal rights to upload, post or submit such content and it will not violate any law or the rights of any person. You shall not upload to, or distribute or otherwise publish to the Services any libelous, defamatory, obscene, pornographic, abusive, or otherwise illegal material.

You are solely responsible for the content of your Submissions. FindEdition reserves the right to delete, move, or edit Submissions that it deems abusive, defamatory, obscene, in violation of copyright or trademark laws, or otherwise unacceptable.

You acknowledge that any submissions you make to the Services may be used, edited, removed, modified, published, transmitted, and displayed by FindEdition. Submissions made to the Services may also be included in our RSS feeds and APIs.

You grant FindEdition a perpetual, nonexclusive, worldwide, royalty-free license to the Submissions, which includes the right to:

• Use, copy, transmit, excerpt, publish, distribute, publicly display, create derivative works of, host, index, cache, tag, encode, modify and adapt in any form or media now known or developed, any Submission posted by you on or to the Services
• Use your content to improve our services, including for AI training and machine learning (with appropriate safeguards)
• Promote and share your content through our platform, social media, and marketing channels
• Archive and preserve your content as part of our platform
• Create derivative works based on your content (such as summaries, translations, or adaptations)

By making a Submission, you are consenting to its display and publication on the Site and in the Services. You retain ownership of your intellectual property rights, but grant FindEdition the license described above.

3(D) Content Moderation

FindEdition reserves the right, but not the obligation, to monitor, review, edit, or remove any user-generated content at any time and for any reason, including but not limited to:

• Content that violates these Terms of Service
• Content that is illegal, harmful, or violates the rights of others
• Content that contains spam, malware, or malicious code
• Content that infringes on intellectual property rights
• Content that is defamatory, harassing, or abusive
• Content that violates community guidelines

You may not access or use the Services to take any action that could harm FindEdition or a third party. You may not use the Services in violation of applicable laws or our intellectual property rights. You may not attempt to circumvent, reverse engineer, decrypt, or otherwise interfere with the Services.

4(A) Prohibited Activities

Without FindEdition's prior written consent, you shall not:

• Immediate termination or suspension of your account

5(A) Your Representations

You represent, warrant and covenant that:

• No materials submitted through your account will violate any law or the rights of any third party
• You are at least thirteen years old
• If you are under eighteen years old, your parent or legal guardian has read these Terms of Service and agreed to them
• All information you provide is accurate, current, and complete
• You have the legal capacity and authority to enter into these Terms of Service
• Your use of the Services will not violate any applicable law or regulation
• You will not use the Services for any illegal or unauthorized purpose

5(B) Indemnification

You hereby indemnify, defend, and hold harmless FindEdition, its affiliates, officers, directors, employees, agents, licensors, and suppliers from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your breach of these Terms of Service
• Your gross negligence or willful misconduct
• Your violation of any law or regulation
• Your infringement of any intellectual property or other rights of any third party
• Your use of the Services in any unauthorized manner

5(C) Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAWS, THE SERVICES ARE DISTRIBUTED ON AN "AS IS" BASIS WITHOUT WARRANTIES OF ANY KIND. FindEdition does not warrant that the Services will be uninterrupted or error-free. FindEdition makes no warranties, express or implied, including but not limited to:

• Warranties of merchantability
• Warranties of fitness for a particular purpose
• Warranties of non-infringement
• Warranties regarding accuracy, completeness, or reliability of content
• Warranties regarding the security of the Services

5(D) Limitation of Liability

IN NO EVENT WILL FindEdition BE LIABLE FOR INDIRECT, CONSEQUENTIAL, SPECIAL, INCIDENTAL, PUNITIVE, OR EXEMPLARY DAMAGES, including but not limited to:

• Loss of profits, revenue, or business opportunities
• Loss of data or information
• Loss of goodwill or reputation
• Costs of substitute services
• Any other indirect or consequential damages

This limitation applies regardless of the theory of liability, whether in contract, tort, strict liability, or otherwise, and even if FindEdition has been advised of the possibility of such damages.

6(A) Account Creation

As part of the registration process, you will create login credentials, including a username and password. You are responsible for maintaining the confidentiality of your password and for all activities that occur under your account.

6(B) Age Requirements

You must be 13 years or older to use the Services. If you are less than 18 years of age, please ask your parent or legal guardian to review and agree to these Terms of Service before you use the Services.

FindEdition Services are not directed to children under 13 years of age. We do not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child under 13, we will delete that information immediately.

6(C) Account Security

You are responsible for all usage on your account, including use by any third party authorized by you. You agree to:

• Use a strong, unique password for your account
• Not share your account credentials with anyone
• Notify us immediately of any known or suspected unauthorized use of your account
• Log out of your account when using shared or public devices
• Keep your account information up to date

6(D) Security Disclaimer

We cannot guarantee that the Services will be free from viruses or other malicious elements. While we implement industry-standard security measures, you are responsible for taking appropriate precautions to protect your devices and data when using the Services.

We reserve the right to charge fees for access to portions of the Services. All fees will be posted prominently on the Services. You shall pay all applicable taxes, duties, and other charges imposed by any governmental authority in connection with your use of the Services.

7(A) Subscription Services

FindEdition may offer subscription services, premium features, or paid content. If you subscribe to any paid service:

• You agree to pay all fees associated with your subscription
• Fees are charged in advance on a recurring basis (monthly, quarterly, or annually)
• Your subscription will automatically renew unless you cancel before the renewal date
• You can cancel your subscription at any time through your account settings
• Refunds are subject to our refund policy, which may vary by service

7(B) Payment Processing

Payments are processed securely through third-party payment processors. By providing payment information, you authorize us to charge your payment method for all fees and charges incurred in connection with your use of the Services.

7(C) Work Marketplace Transactions

If you use FindEdition's work marketplace features (jobs, freelancers, services):

• Service fees may apply to transactions
• Payment terms are agreed upon between employers and freelancers
• FindEdition may facilitate payments but is not a party to work agreements
• Disputes between employers and freelancers should be resolved directly between the parties

7(D) Advertising and Monetization

If you purchase advertising or participate in monetization programs:

• Advertising fees are non-refundable unless otherwise specified
• Creator monetization payments are subject to our monetization terms
• All payments are subject to applicable taxes and fees

The Services contain links to third-party websites, resources, vendors, and advertisers. FindEdition does not control or endorse these third parties. You use them at your own risk.

8(A) Third-Party Services

FindEdition integrates with various third-party services to enhance functionality, including:

• Payment processors for transactions
• Social media platforms for login and sharing
• Analytics providers for service improvement
• Cloud services for hosting and infrastructure
• Email services for communications
• AI and machine learning services

8(B) Your Interactions with Third Parties

Your interactions with third parties are solely between you and such parties. FindEdition shall not be responsible for any loss incurred as the result of such dealings. This includes but is not limited to:

• Transactions with third-party vendors or service providers
• Work agreements between employers and freelancers
• Purchases made through third-party links
• Data shared with third-party services

We grant you a limited, revocable, non-exclusive, non-transferable license to use mobile applications and software provided by FindEdition (the "Software") in accordance with these Terms of Service. You have no rights to the proprietary software provided to access the Services.

9(A) License Restrictions

You may not:

• Copy, modify, or create derivative works of the Software
• Reverse engineer, decompile, or disassemble the Software
• Rent, lease, or sublicense the Software
• Remove or alter any copyright notices or proprietary markings
• Use the Software for any purpose other than accessing the Services

9(B) Tools and Utilities

FindEdition provides various tools and utilities (PDF tools, image tools, text tools, SEO tools, converter tools, generator tools, checker tools, developer tools). These tools are provided "as is" for your use. You may not:

• Extract or reverse engineer the underlying code or algorithms
• Use the tools to create competing services
• Resell or redistribute access to the tools

10(A) Termination by You

You may terminate your FindEdition account at any time by contacting us at [email protected] or by using the account deletion feature in your dashboard settings. Upon termination:

• Your access to the Services will be terminated
• Your account and profile information will be deleted or anonymized
• Your content may be removed or anonymized
• Any active subscriptions will be cancelled
• You will not be entitled to any refunds unless otherwise specified

10(B) Termination by FindEdition

FindEdition may terminate or suspend your access for any reason, including but not limited to:

• Violation of these Terms of Service
• Illegal or fraudulent activity
• Abuse of the Services or other users
• Non-payment of fees
• Extended period of account inactivity

10(C) Survival

The provisions of these Terms of Service will survive the termination of your account, including but not limited to: intellectual property rights, indemnification obligations, limitation of liability, dispute resolution, and governing law provisions.

These Terms of Service are governed by the laws of Pakistan, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms of Service or the Services will be subject to the exclusive jurisdiction of the courts of Pakistan.

If you are located outside Pakistan, you agree that:

• These Terms of Service are governed by Pakistani law
• Any legal proceedings will be conducted in Pakistan
• You consent to the jurisdiction of Pakistani courts
• You waive any objection to venue in Pakistan

You and FindEdition agree that disputes will be resolved by binding arbitration, except for certain limited types of disputes described below. You waive the right to participate in class actions.

12(A) Arbitration Agreement

Except for disputes that qualify for small claims court, all disputes between you and FindEdition arising out of or relating to these Terms of Service, the Services, or your relationship with FindEdition will be resolved through binding arbitration rather than in court.

12(B) Individual Basis

You agree that all disputes between us, whether in court or in arbitration, will be brought only on an individual basis and you are waiving your right to bring or participate in a class arbitration or class action.

12(C) Arbitration Process

Arbitrations will be administered by a neutral arbitration association in accordance with its rules. The arbitration will be conducted in Pakistan, unless both parties agree otherwise. The arbitrator may award money damages or equitable relief, including injunctive relief. The arbitrator's decision will be final and binding on both parties and may be enforced in any court of competent jurisdiction.

Arbitration Procedures:

• The arbitration will be conducted by a single arbitrator selected in accordance with the rules of the arbitration association
• The arbitrator will have the authority to grant any relief that would be available in court
• The arbitration will be conducted on an individual basis, not as a class action
• Each party will bear their own costs and attorneys' fees, unless the arbitrator determines otherwise
• The arbitrator's decision will be in writing and will include findings of fact and conclusions of law

12(D) Exceptions to Arbitration

Notwithstanding the foregoing, the following disputes are not subject to arbitration and may be brought in court:

• Disputes that qualify for small claims court (claims under a certain monetary threshold)
• Intellectual property disputes, including claims of copyright, trademark, or patent infringement
• Claims for injunctive or equitable relief to prevent unauthorized use of the Services
• Claims related to the validity, enforceability, or scope of the arbitration agreement itself

12(E) Class Action Waiver

YOU AND FindEdition AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. This means:

• You may not bring a claim as part of a class action lawsuit
• You may not participate as a member of a class in any class action proceeding
• You may not act as a representative or on behalf of other users
• Any dispute resolution will be conducted on an individual basis only

If this class action waiver is found to be unenforceable, then the entire arbitration agreement will be unenforceable, and disputes will be resolved in court.

12(F) Opt-Out Right

You have the right to opt out of the Arbitration Agreement by sending written notice to [email protected] within thirty (30) days of your first use of the Services. Your opt-out notice must include:

• Your full name and email address associated with your account
• A clear statement that you wish to opt out of the Arbitration Agreement
• The date of your first use of the Services

If you opt out, disputes will be resolved in court rather than through arbitration. Your opt-out will not affect any other part of these Terms of Service, and you will still be bound by all other terms and conditions.

13(A) Entire Agreement

These Terms of Service constitute the entire agreement between you and FindEdition regarding the use of the Services and supersede all prior agreements and understandings, whether written or oral.

13(B) Severability

If a provision of these Terms is held invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.

13(C) Waiver

The failure of FindEdition to exercise or enforce any right or provision of these Terms of Service will not constitute a waiver of such right or provision. Any waiver of any provision of these Terms of Service will be effective only if in writing and signed by FindEdition.

13(D) Assignment

You may not assign or transfer these Terms of Service or your rights or obligations hereunder without FindEdition's prior written consent. FindEdition may assign or transfer these Terms of Service, in whole or in part, without restriction, including to Uninetra or any successor entity.

13(E) Force Majeure

FindEdition will not be liable for any failure or delay in performance under these Terms of Service which is due to earthquake, fire, flood, act of God, act of war, terrorism, epidemic, pandemic, labor dispute, civil commotion, interruption of telecommunications or internet services, or other cause beyond FindEdition's reasonable control.

13(F) Notices

All notices, requests, and other communications under these Terms of Service must be in writing and will be deemed to have been duly given when: (1) delivered by hand, (2) sent by email to the address you provided in your account, or (3) posted prominently on the Services. Notices to FindEdition should be sent to [email protected] or [email protected].

13(G) Headings

The section headings in these Terms of Service are for convenience only and have no legal or contractual effect. They do not affect the interpretation of these Terms of Service.

13(H) Language

These Terms of Service are written in English. If these Terms of Service are translated into other languages, the English version will control in the event of any conflict or discrepancy. Any translations are provided for convenience only and do not have legal effect.

13(I) Export Control

The Services may be subject to export control laws and regulations. You agree to comply with all applicable export control laws and regulations, including but not limited to:

• Laws and regulations of Pakistan
• Laws and regulations of the United States
• Laws and regulations of the European Union
• Any other applicable international export control laws

You will not export, re-export, or transfer the Services or any content in violation of any applicable export control laws or regulations.

13(J) Compliance with Laws

You agree to comply with all applicable laws, rules, and regulations when using the Services. This includes but is not limited to:

• Laws regarding data protection and privacy (GDPR, CCPA, etc.)
• Laws regarding intellectual property and copyright
• Laws regarding employment and labor (for work marketplace users)
• Laws regarding advertising and marketing
• Laws regarding financial transactions and payments
• Laws regarding content moderation and online speech

FindEdition reserves the right to investigate violations of these Terms of Service and may cooperate with law enforcement authorities in prosecuting users who violate applicable laws.

13(K) Digital Millennium Copyright Act (DMCA) and Intellectual Property

FindEdition respects intellectual property rights and expects users to do the same. If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement, please provide our designated copyright agent with the following information:

• A physical or electronic signature of the copyright owner or authorized representative
• Identification of the copyrighted work claimed to have been infringed
• Identification of the material that is claimed to be infringing and information sufficient to locate it
• Your contact information, including name, address, telephone number, and email address
• A statement that you have a good faith belief that use of the material is not authorized by the copyright owner
• A statement that the information in the notification is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner

FindEdition will respond to valid copyright infringement notices in accordance with applicable law, which may include removing or disabling access to the allegedly infringing material.

13(L) Relationship of Parties

Nothing in these Terms of Service creates any agency, partnership, joint venture, employment, or franchise relationship between you and FindEdition. You are an independent user of the Services and have no authority to bind FindEdition in any way.

For work marketplace users: The relationship between employers and freelancers is that of independent contractors. FindEdition is not a party to any work agreements and does not act as an employer, employment agency, or staffing firm.

13(M) Uninetra Ownership and Charitable Mission

FindEdition may update, modify, or discontinue any aspect of the Services at any time, including:

• Adding or removing features, content sections, or services
• Changing the design, layout, or functionality of the Services
• Updating software, tools, or technical infrastructure
• Modifying pricing, subscription terms, or payment methods
• Implementing new security measures or access controls

We will provide reasonable notice of material changes when possible, but we are not obligated to do so for all changes. Your continued use of the Services after changes constitutes acceptance of the updated Services.
