FindEdition respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA) and other applicable intellectual property laws, we have implemented procedures for receiving and responding to notices of alleged copyright infringement.

This DMCA Policy explains how we handle copyright infringement claims, the process for filing a DMCA takedown notice, and the counter-notification process. This policy should be read together with our Terms of Service and Privacy Policy.

1. Overview of DMCA

The Digital Millennium Copyright Act (DMCA) is a United States copyright law that provides a safe harbor for online service providers like FindEdition. The DMCA establishes procedures for copyright owners to request removal of infringing content and for users to file counter-notifications if they believe their content was wrongfully removed.

FindEdition's Commitment: We are committed to protecting intellectual property rights and complying with the DMCA. We respond promptly to valid DMCA takedown notices and take appropriate action against repeat infringers.

1(A) What Content is Protected by Copyright?

Copyright protects original works of authorship, including but not limited to:

  • Written Content: Articles, blog posts, stories, poems, scripts, and other written works
  • Images and Graphics: Photographs, illustrations, graphics, logos, and visual artwork
  • Audio Content: Music, podcasts, sound recordings, and audio files
  • Video Content: Movies, TV shows, video clips, animations, and video recordings

  • Designs and Layouts: Website designs, user interfaces, and layout designs
  • Other Creative Works: Choreography, architectural works, and other creative expressions

Note: Copyright does not protect facts, ideas, concepts, or methods. However, the expression of these ideas may be protected.

1(B) What Constitutes Copyright Infringement?

Copyright infringement occurs when someone uses copyrighted material without permission from the copyright owner. This includes:

  • Reproducing copyrighted work without authorization
  • Distributing copyrighted material without permission
  • Creating derivative works based on copyrighted material
  • Publicly displaying or performing copyrighted work without authorization
  • Uploading copyrighted content to websites or platforms without permission

Fair Use Exception: Some uses of copyrighted material may be considered "fair use" under copyright law, such as criticism, comment, news reporting, teaching, scholarship, or research. However, fair use is determined on a case-by-case basis.

3. How to File a DMCA Takedown Notice

If you believe that content on FindEdition infringes your copyright, you may file a DMCA takedown notice. To be valid, your notice must comply with the requirements set forth in Section 512(c)(3) of the DMCA.

3(A) Who Can File a DMCA Notice?

A DMCA takedown notice may be filed by:

  • Copyright Owners: The owner of the copyrighted work that has been infringed
  • Authorized Representatives: Someone authorized to act on behalf of the copyright owner (e.g., attorney, agent, licensee)
  • Exclusive Licensees: Parties who hold exclusive rights to the copyrighted work

Note: You must have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law. Filing a false notice may result in liability.

3(B) Steps to File a DMCA Notice

  1. Identify the Infringing Content: Locate the specific URL(s) or location(s) where the infringing material appears on FindEdition
  2. Gather Required Information: Collect all information required for a valid DMCA notice (see Section 4)
  3. Prepare Your Notice: Draft your DMCA notice including all required elements
  4. Sign the Notice: Include your physical or electronic signature
  5. Send to Designated Agent: Email your notice to [email protected] with "DMCA Takedown Notice" in the subject line
  6. Wait for Response: We will acknowledge receipt and process your notice according to our DMCA procedures

4. Required Information for Takedown Notices

To be valid under the DMCA, your takedown notice must include all of the following information:

4(A) Physical or Electronic Signature

Your notice must include either:

  • A physical signature of the copyright owner or authorized representative
  • An electronic signature (e.g., typed name, scanned signature, or digital signature)

Example: "John Doe, Copyright Owner" or a scanned signature image

4(B) Identification of Copyrighted Work

You must identify the copyrighted work that you claim has been infringed. This should include:

  • Title of the copyrighted work
  • Author or creator of the work
  • Copyright registration number (if applicable)
  • Description of the work and its original location
  • Link to the original work (if available online)

Example: "The article 'Understanding AI Technology' by Jane Smith, originally published on example.com/article, registered with the U.S. Copyright Office under registration number TX-1234567"

4(C) Identification of Infringing Material

You must provide sufficient information to locate the allegedly infringing material on FindEdition:

  • Complete URL(s) where the infringing material appears
  • Specific page or section where the material is located
  • Description of the infringing material
  • Screenshots or other evidence of the infringement (if helpful)

Example: "The infringing material appears at: https://findedition.com/news/article-title, specifically in the article content section"

4(D) Contact Information

You must provide your contact information, including:

  • Your full name
  • Mailing address (street address, city, state, ZIP code, country)
  • Telephone number
  • Email address

Note: This information is required so we can contact you regarding your notice and so the alleged infringer can contact you if they file a counter-notification.

4(E) Good Faith Statement

You must include a statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by:

  • The copyright owner
  • The copyright owner's agent
  • The law

Example: "I have a good faith belief that the use of the copyrighted material described above is not authorized by the copyright owner, its agent, or the law."

4(F) Accuracy Statement

You must include a statement that the information in the notification is accurate, and under penalty of perjury, that you are:

  • The copyright owner, or
  • Authorized to act on behalf of the copyright owner

Example: "The information in this notification is accurate, and under penalty of perjury, I am the copyright owner or authorized to act on behalf of the owner of an exclusive right that is allegedly infringed."

5. Our DMCA Process

When we receive a valid DMCA takedown notice, we follow a standardized process to ensure compliance with the DMCA and fair treatment of all parties involved.

5(A) Receipt and Review

Step 1: Acknowledgment

Upon receiving your DMCA notice, we will:

  • Acknowledge receipt of your notice within 1-2 business days
  • Review your notice for completeness and compliance with DMCA requirements
  • Verify that all required information is included

Processing Time: We typically process valid DMCA notices within 1-3 business days of receipt.

5(B) Content Review and Verification

Step 2: Investigation

We will:

  • Locate and review the allegedly infringing content
  • Verify that the content matches the description in your notice
  • Check if the content user has a history of copyright violations
  • Review any relevant context or fair use considerations

5(C) Action Taken

Step 3: Removal or Response

If your notice is valid and complete, we will:

  • Remove or disable access to the allegedly infringing material
  • Notify the user who posted the content about the removal
  • Provide the user with a copy of your DMCA notice
  • Inform the user of their right to file a counter-notification
  • Document the takedown in our records

Notification to You: We will notify you when the content has been removed or if we need additional information.

5(D) Incomplete or Invalid Notices

If your notice is incomplete or does not meet DMCA requirements, we will:

  • Contact you to request the missing information
  • Explain what information is needed to process your notice
  • Provide guidance on how to complete your notice

Note: We cannot process incomplete notices. Please ensure all required information is included in your initial notice to avoid delays.

6. Counter-Notification Process

If you believe that your content was wrongfully removed due to a DMCA notice, you have the right to file a counter-notification under Section 512(g) of the DMCA.

6(A) When to File a Counter-Notification

You may file a counter-notification if:

  • You believe your content was removed by mistake or misidentification
  • You have a good faith belief that the material was removed due to a mistake
  • You own the copyright to the material or have authorization to use it
  • The use of the material is protected by fair use or another legal exception
  • You have permission from the copyright owner to use the material

⚠️ Warning: Filing a counter-notification is a legal action. If you file a counter-notification, the original complainant may file a lawsuit against you. Only file a counter-notification if you are certain that your content does not infringe copyright.

6(B) Required Information for Counter-Notifications

Your counter-notification must include:

  • Physical or Electronic Signature: Your signature or typed name
  • Identification of Removed Material: Description of the material that was removed and its location before removal
  • Good Faith Statement: A statement that you have a good faith belief that the material was removed due to mistake or misidentification
  • Contact Information: Your name, address, telephone number, and email address
  • Consent to Jurisdiction: A statement that you consent to the jurisdiction of the federal court in your district (or if outside the U.S., the jurisdiction where FindEdition is located)
  • Service of Process: A statement that you will accept service of process from the person who filed the original DMCA notice

6(C) Counter-Notification Process

Step 1: File Your Counter-Notification

Send your counter-notification to [email protected] with "DMCA Counter-Notification" in the subject line.

Step 2: Our Review

We will review your counter-notification for completeness and compliance with DMCA requirements.

Step 3: Forward to Original Complainant

If your counter-notification is valid, we will:

  • Forward your counter-notification to the person who filed the original DMCA notice
  • Inform them that we may restore the content in 10 business days
  • Notify them that they may file a lawsuit to prevent restoration

Step 4: Restoration of Content

We will restore the removed content within 10-14 business days after receiving your counter-notification, unless:

  • The original complainant files a court action seeking a court order to restrain you from engaging in infringing activity
  • We receive notice that a lawsuit has been filed

7. Repeat Infringer Policy

FindEdition maintains a strict policy against repeat copyright infringers. In accordance with the DMCA and our Terms of Service, we will terminate the accounts of users who are determined to be repeat infringers.

7(A) What is a Repeat Infringer?

A repeat infringer is a user who has:

  • Received multiple valid DMCA takedown notices
  • Had content removed due to copyright infringement on multiple occasions
  • Demonstrated a pattern of posting infringing content
  • Failed to respond appropriately to copyright infringement warnings

Our Policy: Users who receive multiple valid DMCA notices may have their accounts terminated, and we may take additional legal action as necessary.

7(B) Our Repeat Infringer Procedures

When we identify a potential repeat infringer, we will:

  • Review the user's account history and DMCA notice records
  • Verify that all DMCA notices were valid and properly processed
  • Consider any counter-notifications or explanations from the user
  • Make a determination based on the totality of circumstances
  • Take appropriate action, which may include account termination

8. False Claims and Penalties

Filing a false or fraudulent DMCA notice is a serious matter and may result in legal liability. The DMCA provides penalties for knowingly misrepresenting that material is infringing.

8(A) Penalties for False Claims

Under Section 512(f) of the DMCA, anyone who knowingly materially misrepresents that material is infringing may be liable for:

  • Damages, including costs and attorneys' fees, incurred by the alleged infringer
  • Damages incurred by the service provider (FindEdition)
  • Damages incurred by any copyright owner or authorized licensee
  • Any other damages resulting from the misrepresentation

Important: Before filing a DMCA notice, ensure you have a good faith belief that the material actually infringes your copyright. Do not file a notice if you are unsure or if the use may be protected by fair use.

8(B) What Constitutes a False Claim?

A false or fraudulent DMCA notice may include:

  • Filing a notice for material you do not own or have rights to
  • Filing a notice when you know the use is authorized or protected by fair use
  • Filing a notice to harass or silence someone
  • Filing a notice with false or misleading information
  • Filing a notice without a good faith belief that infringement has occurred

9. DMCA and Specific FindEdition Features

FindEdition offers various features where user-generated content may be posted. This section explains how DMCA applies to specific features:

9(A) Content Sections (News, Editorial, Magazine, etc.)

If you believe that content in our News, Editorial, Magazine, Archive, Press, Tech, Docs, Research, Trends, Events, Podcast, Labs, Academy, or Creators sections infringes your copyright:

  • Include the specific URL of the article or content in your DMCA notice
  • Identify the specific section where the content appears
  • Provide details about which parts of the content are infringing

We will review and remove infringing content from these sections in accordance with our DMCA procedures.

9(B) User-Generated Content and Comments

User comments, posts, and other user-generated content are subject to DMCA takedown notices:

  • Include the URL of the specific comment or post in your notice
  • Identify the user who posted the content (if known)
  • Provide evidence that the content infringes your copyright

We will remove infringing user-generated content and may take action against the user who posted it.

9(C) Work Marketplace Content

If copyrighted material appears in job listings, freelancer profiles, company profiles, or work marketplace content:

  • Include the URL of the specific listing or profile
  • Identify which elements (images, text, logos, etc.) are infringing
  • Provide proof of your copyright ownership

We will remove infringing content from work marketplace listings and may suspend or terminate the account of the user who posted it.

9(D) Tools and Generated Content

Content generated using FindEdition tools (PDF tools, image tools, text tools, SEO tools, converter tools, generator tools, checker tools, developer tools) may be subject to DMCA notices if:

  • The generated content incorporates copyrighted material without authorization
  • The tool output infringes on your copyright
  • User-uploaded content used with tools contains copyrighted material

Note: FindEdition tools themselves are our intellectual property. However, content generated or processed using these tools may be subject to DMCA notices if it infringes third-party copyrights.

9(E) AI Chat and AI-Generated Content

Content generated through FindEdition AI Chat (FindEdition AI Studio) or other AI features:

  • May be subject to DMCA notices if it reproduces copyrighted material
  • Users are responsible for ensuring AI-generated content does not infringe copyright
  • We will remove AI-generated content that infringes copyright upon receiving a valid DMCA notice

User Responsibility: Users who generate content using AI features must ensure they have the right to use any copyrighted material incorporated into the generated content.

9(F) Community Features (Questions and Answers)

Questions, answers, and other community content are subject to DMCA notices:

  • Include the URL of the specific question or answer in your notice
  • Identify which parts of the content are infringing
  • Provide evidence of copyright ownership

10. Updates to This Policy

We may update this DMCA Policy from time to time to reflect changes in our practices, legal requirements, or other factors. When we make changes, we will:

  • Update the "Last Updated" date at the top of this page
  • Notify you of significant changes through email (if you have an account) or through a prominent notice on our website
  • Maintain previous versions of this policy for your reference
